{"id":3480,"date":"2026-07-10T09:45:24","date_gmt":"2026-07-10T09:45:24","guid":{"rendered":"https:\/\/www.indextap.com\/blog\/?p=3480"},"modified":"2026-07-10T09:46:43","modified_gmt":"2026-07-10T09:46:43","slug":"lower-stamp-duty-approved-for-99-year-society-leases","status":"publish","type":"post","link":"https:\/\/www.indextap.com\/blog\/lower-stamp-duty-approved-for-99-year-society-leases\/","title":{"rendered":"Lower Stamp Duty Approved for 99-Year Society Leases"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Maharashtra Revenue Minister Chandrashekhar Bawankule announced a significant reduction in stamp duty on such registrations, which could benefit thousands of cooperative housing societies in Mumbai that have been unable to register lease agreements for decades due to procedural delays and high stamp duty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to a PTI report, stamp tax on residential properties has been set at 0.5%, while commercial buildings would have a maximum rate of 1.5%, Bawankule informed the Maharashtra Legislative Assembly on July 7.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Previously, stamp duty may be as high as 5%, depending on the lease periods, premium paid, and other criteria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The updated regulation is likely to bring major assistance to cooperative housing societies built on government land leased for 99 years, many of which had previously encountered difficulties in registering their lease agreements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Applicability and qualifying criteria<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to Maharashtra government authorities, the incentive is applicable to residential cooperative housing societies on leasehold land and is likely to help both existing societies looking to regularize lease papers and newly created societies completing legal formalities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They stated that the concessional tariffs would be applied equitably throughout Mumbai and its suburbs. The decision is expected to bring significant financial relief to hundreds of cooperative housing societies in regions including Nariman Point, Cuffe Parade, Colaba, Marine Drive, and the Mumbai suburbs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On July 7, Bawankule announced a reduction in stamp duty for Mittal Chambers Owners Cooperative Society in South Mumbai from about \u20b9101.21 crore to \u20b910.68 lakh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New Maker Chambers&#8217; obligation will be reduced from \u20b9119.47 crore to \u20b91.76 crore, while Sea Lot Cooperative Housing Society in Colaba would pay approximately \u20b927.05 lakh instead of \u20b9176.82 crore. The stamp duty on Abhilasha Premises Society in Colaba will be decreased from around \u20b9104.83 crore to \u20b919.45 lakh, according to the speaker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lease agreements are an important aspect of Mumbai&#8217;s housing industry because many cooperative housing societies are based on leasehold land rather than freehold plots. In many situations, the land is owned by government agencies, public bodies, or private organizations, with societies holding long-term lease rights. Registering these agreements is required for establishing legal ownership, obtaining redevelopment approvals, procuring funding, and conducting property exchanges.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is leasehold land?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In a leasehold arrangement, purchasers own their flats while the land is leased from the lessor. As a result, the cooperative housing association does not obtain absolute possession of the land via a conveyance deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Mumbai, leasehold land is commonly controlled by government agencies such as the Maharashtra Housing and Area Development Authority (MHADA), City and Industrial Development Corporation (CIDCO), and Mumbai Metropolitan Region Development Authority (MMRDA), as well as private entities such as family trusts.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What is freehold land?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The freehold land model involves the developer permanently transferring ownership of the land to the housing society. The conveyance deed is executed in the society&#8217;s name, granting it complete ownership of the land.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Stamp duty reduced to encourage redevelopment.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">According to Maharashtra government officials, the stamp duty reduction is noteworthy, given that Mumbai is seeing an increase in redevelopment projects involving aging residential structures.
