The IBC was introduced in 2016 to provide a legal framework for dealing with companies that are unable to repay their debts. Insolvency cases are handled by the National Company Law Tribunal (NCLT), while the framework is administered by the Insolvency and Bankruptcy Board of India (IBBI).

Homebuyers Are Financial Creditors

A major change came in 2018 when the IBC was amended to recognise people who had paid money to book homes as financial creditors. In practical terms, money paid by a homebuyer to a developer is treated as a financial debt owed by the developer.

This gives eligible homebuyers the ability to approach the NCLT and initiate insolvency proceedings against a developer that has defaulted.

What Happens When a Builder Enters Insolvency?

Once insolvency proceedings begin, a Resolution Professional (RP) is appointed to manage the company during the resolution process.

The RP can invite resolution plans from prospective investors or other parties interested in taking over or resolving the developer’s business/project.

Homebuyers, as financial creditors, are represented on the Committee of Creditors (CoC). The CoC plays an important role in deciding how the insolvent developer’s debts, assets and resolution process are handled.

Priority Is Completing the Housing Project

According to the article, the framework seeks to prioritise the completion of housing projects and protection of homebuyers’ investments, rather than simply liquidating the developer’s assets.

This means a developer becoming insolvent does not automatically mean that buyers lose their homes or investments. The insolvency process may result in another investor or resolution applicant stepping in and completing or restructuring the project.

What Changed in 2026?

The article notes that the Insolvency and Bankruptcy Code (Amendment) Act, 2026 received Presidential assent on April 6, 2026.

According to TOI, the amendment introduced changes covering areas including admission timelines, creditor-initiated resolution, liquidation supervision, group insolvency and cross-border insolvency. It also strengthened creditor oversight during liquidation.

What Should a Homebuyer Do?

If your developer has been declared insolvent, the most important thing is to act quickly.

You should check the IBBI website or the relevant NCLT proceedings to establish whether insolvency proceedings have been initiated against the developer. If proceedings are underway, the homebuyer should submit a formal claim within the prescribed deadline.

Missing the deadline can affect the buyer’s ability to recover money or ultimately obtain possession of the property. Claims may be submitted individually or, where applicable, through a collective/authorised representative.

Homebuyers may also seek advice from a lawyer experienced in IBC and real-estate insolvency proceedings.

In simple terms: Builder bankruptcy does not automatically mean your home is gone. Homebuyers have creditor rights under IBC, can participate in the insolvency process, and need to file their claims on time to protect their interests.

Stay informed with IndexTap for the latest updates on Mumbai’s infrastructure and real estate developments.

If a real estate developer becomes insolvent or bankrupt, homebuyers have specific protections under India’s Insolvency and Bankruptcy Code (IBC).
