The Maharashtra government has tightened the redevelopment process for cooperative housing societies, emphasizing member engagement, timely documentation, and majority consent in the hiring of developers.<\/p>\n\n\n\n
According to a Government Resolution (GR) published by the Co-operation Department on September 30, 2026, redevelopment decisions require a two-thirds quorum and approval from at least 51% of the society’s total members. The GR also allows for virtual participation in some circumstances, particularly for senior citizens and members residing overseas.<\/p>\n\n\n\n
Members who live overseas, are seriously ill, have disabilities, or are unable to attend due to unavoidable circumstances can participate via VC\/remote technologies, according to the revised policy statement.<\/p>\n\n\n\n
Furthermore, members who vote in favor of redevelopment must provide written consent. The process also requires societies to solicit at least three competitive bids from developers, with an option to extend the deadline if fewer offers are received.<\/p>\n\n\n\n
The government has stipulated that the Development Agreement (DA) be signed within three months after its registration, as well as the registered Permanent Alternative Accommodation Agreement (PAAA).<\/p>\n\n\n\n
All redevelopment-related documentation, such as meeting minutes, tender documents, and recordings, must be made available for review by society members.<\/p>\n\n\n\n
The amended requirements apply to the redevelopment of cooperative housing societies, including various types of redevelopment covered by the government’s framework, and supersede the order’s previous 2019 procedure and related circulars.<\/p>\n\n\n\n
The new policy also says that, depending on the size of the redevelopment project, it must be completed within two years after the date of the first\/plinth certificate, or three years in extraordinary situations.<\/p>\n\n\n\n
Violation of orders, collusion, fraud, deception, or activities adverse to members’ interests may result in legal action against the responsible office-bearers\/committee members under the Cooperative Societies Act.<\/p>\n\n\n\n
The updated approach requires that at least 51% of the society’s entire membership approve the initial decision to commence reconstruction. The special general meeting requires a quorum of two-thirds.<\/p>\n\n\n\n
Members who live overseas, are seriously ill, have impairments, or are unable to attend due to unavoidable circumstances can participate via VC\/remote systems. Such participation counts toward both the quorum and the 51% majority. The same provision applies to the developer selection meeting. The developer-selection meeting must also be videotaped, with one copy kept by the society and another sent to the registrar.<\/p>\n\n\n\n
After the redevelopment resolution is passed, the managing committee must get written consent from members who voted in favor of it before moving forward. Similarly, at least 51% of the whole membership participating physically or through VC must provide written approval\/consent for developer nomination. Absent members’ votes or opinions will not be considered.<\/p>\n\n\n\n
The appointed architect or Project Management Consultant (PMC) must survey the building and land, review available FSI and TDR, research relevant development regulations, and prepare a realistic project report that includes residential and commercial areas, open spaces, gardens, and parking.<\/p>\n\n\n\n
The society must then invite developer tenders, with a minimum of three tenders constituting the desired competitive process. If fewer than three bids are submitted, the tender period will be extended before the available bids are presented to the Special General Meeting (SGM).<\/p>\n\n\n\n
The decision demands that all redevelopment-related materials, such as meeting notifications and minutes, video recordings, PMC reports, tender documents, comparison statements, and draft development agreements, be made available to members for free inspection.<\/p>\n\n\n\n
The developer-selection meeting must be held in the presence of a registrar-authorized officer, and the society must submit the necessary minutes, signed consents, attendance records, and other documentation to the registrar within 14 days.<\/p>\n\n\n\n
After selecting a developer, the society must execute the development agreement (DA) within three months. Importantly, the decision states that the Permanent Alternative Accommodation Agreement (PAAA) with individual members must be filed and executed within three months of the development agreement’s registration date.<\/p>\n\n\n\n
